The Alien Registration Act

The Alien Registration Act of 1940 is a U.S. law requiring foreign nationals aged 14 and older, who remain in the U.S. for 30 days or more, to register and be fingerprinted with the federal government. This law was passed due to national security concerns related to World War II and has historically not been regularly enforced. However, as of April 11, 2025, a new regulation began enforcing the registration requirement for all unregistered non citizens in the U.S.. Failure to register or carry proof of registration can result in fines, imprisonment, or deportation.
 

Who Must Register?

You must register if you are a foreign national (alien) aged 14 or older who will be in the U.S. for 30 days or longer and have not already registered or been fingerprinted. This includes individuals who are present in the U.S. without legal status. 

Who is Already Registered?

Many noncitizens are already considered to have registered, including: 

  • Lawful Permanent Residents (Green Card holders)
  • Individuals who received a visa and were fingerprinted during the visa application process
  • Nonimmigrants admitted with an I-94 form
  • Individuals granted immigration parole
  • Persons with an Employment Authorization Document

The Registration Process 

  • Complete the Form: You must fill out a specific form (Form G-325R is currently used) on the USCIS website.
  • Provide Biometric Data: You will be called for a biometrics appointment to submit fingerprints.
  • Receive Proof of Registration: After completing the process, you will receive proof of your alien registration.
Key Requirements
  • Carry Proof of Registration:

    Individuals 18 and older must always carry proof of registration, such as an I-94 or Green Card. 

    Report Address Changes:
    Registered aliens must report any change of address to USCIS within 10 days of moving.
